One Stop Distribution, Inc. (collectively “One Stop Distribution, Inc.”, “ODI”, “we” or “our”) is committed to maintaining the privacy of users who access our website (the “Site”) and our digital properties, including but not limited to our digital/mobile app (the “App”), and the confidentiality of personal data in our possession or under our control.
This Privacy Policy Statement explains the types of information we gather and what we do with it. By using the Site/App, you agree to the terms and policies described in this Privacy Policy and you provide consent for us to process your Personal Data for our subsidiaries, affiliates, contractors, service providers and other authorised third parties’ legitimate purposes, and to make your Personal Data available to them.
We may update this Statement from time to time to reflect changes in the law and/or our internal standards. When we do so, we will notify you by posting the updated Statement on this Site/App.
1. Information / Personal Data collected about you
ODI does not request or require any information from anonymous visitors to the Site/App. We collect personal information only from those users who wish to conduct business transactions on the Site/App and who have registered on the Site/App (“Registered Users”).
Personal information means information about an identifiable individual and may include your name, address, telephone and fax number, e-mail address, financial information such as a credit card number, and employment-related information such as may be found on a résumé or job application. Personal information does not include business contact information in those jurisdictions which do not recognise such information as being personal information.
You are responsible for maintaining the confidentiality of any User ID which may be assigned to you, as well as any account number, account name or passwords, if applicable, for the services you use through the Site/App.
2. What we do with Personal Data and Collected Data
ODI needs the information Registered Users supply for personal identification; to contact you for services or opportunities as requested by you, such as customer service or information about a job opportunity if you have submitted a résumé online; to make improvements to materials or products offered on the Site/App and to the Site/App in general; and to enable Registered Users to access the functionalities described on the Site/App, including tracking shipments, viewing outstanding charges, applying for employment and obtaining other user-specific information.
Your e-mail address is collected to send you an email confirming your new member registration, as well as confirmations for other services you transact with ODI online.
In addition, we may use such information for demographic profiling, ad targeting, statistical analysis, surveys and similar marketing activities; to investigate violations of this Privacy Policy or our Terms of Use; and to notify Registered Users about important changes to the Site, promotions or opportunities. You may always decline to receive these messages by following the opt-out process described within a particular message.
We will deactivate accounts of Registered Users that have been inactive for an extended period of time. Registered Users may access and change their information at any time via the Site/App as described in Section 14.
3. Retention of Personal Data and Collected Data
ODI and/or its duly authorised third party shall retain the Personal Data and Collected Data for a maximum period of five (5) years, counted from the date the data subject provided it to ODI, or from when it was collected, respectively.
4. Provision of Information to Others
When you submit personal information through this Site/App, you understand and agree that this information may be transferred across national boundaries and may be stored and processed in any of the countries in which ODI transacts business, including without limitation the Philippines. In certain countries, or with respect to certain activities, the collection, transfer, storage and processing of your information may be undertaken by our trusted vendors. Such vendors are bound by contract not to use your personal information for their own purposes and to treat the information as confidential.
ODI has established relationships with various service providers whose services are available to you from this Site/App or from linked websites. In order to use those services, you may be required to provide personal information to the providers. Unless expressly provided to the contrary, personal information that you provide while visiting a provider’s website will be subject to the privacy policy posted on that site.
Depending upon the activity, some information is identified as mandatory and some as voluntary. If you do not provide the mandatory data for a particular activity, you will not be able to engage in that activity.
If ODI sells assets to another entity, or is acquired by or merged with another entity, we may provide to such entity customer information related to that part of our business without your consent.
Other than as described in this Privacy Policy, we do not provide information supplied by users to any third parties, except where law, court order or governmental authority requires it, or based upon the good faith belief that disclosure is necessary to protect the rights of ODI.
5. Website / App visitors under the age of 18
No one under the age of eighteen (18) (“Minors”) may provide any Personal Data on the Site/App. ODI does not knowingly collect Personal Data from Minors. If you are a Minor, please do not use or provide any information about yourself on this Site/App.
6. Use of Cookies and Log Files
The Site/App does not use persistent or stored cookies; however, it does use temporary or per-session cookies. These act as a randomly generated session ID, last only while the Registered User is logged in, and are cancelled at the end of the session.
The Site/App uses temporary cookies for security purposes. Each time a Registered User logs on, the server generates a temporary session ID associated with the user’s login name, password and computer for that session, allowing movement from page to page without re-entering credentials. On logout the session ID is cancelled and removed.
We also use log files for anonymous Site/App usage analysis. A log file is a data file that records a Registered User’s activity while using the Site/App.
7. Rights of the Data Subject
A data subject is entitled to certain rights in relation to the Personal Data collected from them:
- Right to be informed that their personal data will be, are being, or were collected and processed.
- Right to access the personal data that ODI has processed about them.
- Right to object to the collection and processing of their personal data, including for direct marketing, profiling and automated processing.
- Right to damages for any damages sustained due to inaccurate, incomplete, outdated, false, unlawfully obtained or unauthorised use of personal data.
- Right to erasure or blocking — to suspend, withdraw or order the blocking, removal or destruction of their personal data.
- Right to file a complaint before the National Privacy Commission (NPC).
- Right to rectify any inaccuracy or error in the data processed by ODI.
- Right to data portability — to obtain and electronically move, copy or transfer the personal data provided to ODI.
A data subject may email onestopdistribution@msl.com.ph to request access to, correct and/or delete any Personal Data provided to us. Please note we cannot delete Personal Data without restricting or removing our ability to address your concerns, and we may not accommodate a request where doing so would violate a legal requirement or cause the data to be incorrect.
8. Security
ODI stores information received from Registered Users on secure computers. Only a small number of ODI employees and/or contractors have physical access to these computers. We use firewalls and other security technology to prevent unauthorised access.
While we have taken measures to protect Registered Users’ information, please note that no computer system is immune from intrusion, and information transmitted to the Site/App may pass through many systems in order to be processed. ODI cannot guarantee the absolute security or confidentiality of information transmitted to the Site/App.
9. How personal data collection, use, disclosure and storage are managed
We may process personal data about a data subject if the processing is necessary for the performance of a contract between a data subject and us; for taking steps at a data subject’s request with a view to entering into a contract; for compliance with any legal obligation to which we are subject; to protect a data subject’s vital interests; for the administration of justice; and for the exercise of functions conferred on any person or under any law. Otherwise, we will obtain the data subject’s consent prior to collection or processing.
10. Obtaining Consent
Personal data we process may or may not be sensitive personal data, such as information about race, ethnic origin, political opinions, religious beliefs, physical or mental health, the commission or alleged commission of any offence, and government-issued identification.
We will not process sensitive personal data unless we obtain express consent, the processing is necessary for a purpose permitted by law, or it is otherwise allowed by existing laws, rules and regulations.
Where we obtain consent, we will state whether it is obligatory or voluntary to supply the personal data and, where obligatory, the consequences of failing to supply it.
11. Withdrawal of Consent
If the data subject has given us consent to collect, use, disclose, store and otherwise process their personal data, that consent may be withdrawn at any time. The data subject should give us reasonable advance notice of the withdrawal.
12. Links to Other Sites
The Site/App may contain links to websites other than our own, for which we are not responsible. Such websites may collect personal information from you, may send their own cookies, and may use information in a way inconsistent with our Privacy Policy. Unless expressly provided to the contrary, the collection and use of your personal information will be governed by the privacy policy applicable to that website. Unless ODI explicitly states otherwise, such references in no way indicate our endorsement of any products, services or information on any other website.
13. Additional Information
ODI may alter, update or otherwise change this Privacy Policy at any time to reflect material changes in the way ODI uses your information. Any such changes will be posted on this page. You should periodically check this Privacy Policy to review the current terms applicable to your use. Your continued use of the Site/App following the posting of such changes will indicate your full acceptance of those changes.
14. Updating your Personal Information, Opt-Out Policy
At any time, you can access and correct your personal information and privacy preferences, including exercising your right to unsubscribe, by using the “My Account” page or by emailing onestopdistribution@msl.com.ph.
